PRIVACY POLICY GOLF CLUB PERALADA

This privacy policy aims to inform you about the processing of personal data of users (“Users”) of the website ≪www.golfperalada.com≫ (“the Website”), carried out by Hotel Peralada Wine Spa y Golf, S.L.U. (hereinafter, "Golf Peralada" or “Hotel Peralada”) in accordance with Regulation 2016/679 (UE), of April 27 2016, on the protection of natural persons with regard to the processing of personal data (“RGPD”) and Organic Law 3/2018, of December 5, on the Protection of Personal Data and the Guarantee of Digital Rights (“LOPD”).

  1. Identification and Contact Details of the Data Controller

The data controller of Users’ personal data is Hotel Peralada, with registered office at Carrer Pere II de Montcada, 1, 08034 Barcelona, Spain and Identification Number (CIF): B-67509620.

Hotel Peralada has appointed a Data Protection Officer, to whom you may address any questions or concerns regarding any aspect of this privacy policy.   1. Categories of Processed Data

In the context of providing the services available on the Website, Golf Peralada may process the following categories of personal data:

  • Identification and contact data: first name and surname; ID card, passport or other identification document number; nationality; gender; email address; postal address; date of birth; telephone number; and federation license number.
  • Banking data: bank account number (in the case of direct debit payments); payment method; payment instrument identification data (bank card number and expiry date); amount to be paid; and payment date.
  • CCTV images: images captured during events and competitions through the video surveillance system installed at Golf Peralada’s premises. This system is properly signposted with informative notices alerting individuals to the presence of video surveillance and the corresponding processing of personal data.
  • Social media: Data provided by Users through the corporate social media profiles where Golf Peralada has a presence, such as Instagram or Facebook.
  • Browsing data: information collected through cookies regarding Users’ activity on the Website, as set out in the Cookie Policy
  • Other data: data related to Golf Peralada share ownership; handicap; and the sport club to which the User belongs.
  1. Basic Information on the Processing of Personal Data

Below, we inform you about the different purposes for which Golf Peralada may process Users’ personal data, along with the legal basis for each type of processing:

  1. Recipients

As a general rule, Golf Peralada will not share Users’ personal data with third parties. However, in certain cases, data may need to be shared with:

  • Services suppliers: Personal data may be accessed by those suppliers who require it to deliver their services to Golf Peralada, such as hosting suppliers, booking management system suppliers, and suppliers of commercial communication delivery and management services. These third parties will act as (sub) processors on behalf of Golf Peralada and will provide appropriate safeguards to protect Users’ personal data, including entering into the corresponding data processing agreement in accordance with Article 28 of RGPD.
  • Others: Golf Peralada may share Users’ personal data with third parties when required to do so by law and/or by an administrative or judicial authority, or when necessary for reasons of public interest or public order.

Finally, in the event of a corporate reorganization, merger, spin-off, or sale, Golf Peralada may transfer all personal information of Website Users to the third party resulting from such transaction, based on the legitimate interest of the transferor in accordance with Article 21 of LOPD.

  1. International Transfers

As a general rule, Golf Peralada will not directly carry out transfers of Users’ personal data outside the European Economic Area.

However, certain service suppliers that render services to Golf Peralada, particularly those related to data hosting, booking management systems, and commercial communication delivery, including newsletters, may process Users’ personal data outside the European Economic Area. In such cases, Golf Peralada will contractually require these suppliers to ensure the protection of Users’ personal data by adopting appropriate safeguards, notably through the execution of the Standard Contractual Clauses approved by the European Commission, in accordance with Article 46 of RGPD.Principio del formulario

  1. Retention Periods and Security Measures

Users’ personal data will be retained only for the period strictly necessary to fulfil the purpose for which it was collected and processed. Before its complete deletion, the personal data will remain blocked until the expiration of the limitation periods for any legal obligations or liabilities that may apply to Golf Peralada.

Images obtained through the video surveillance system (CCTV) installed on Golf Peralada’s premises will be stored for a maximum period of 30 days from the date of capture. As an exception to the foregoing, if there are indications of the commission of an unlawful act, such images may need to be communicated to the competent authority (i.e. law enforcement or judicial authority) and retained for a longer period, insofar as it is necessary for the progress of the corresponding investigation.

Hotel Peralada will implement the necessary technical and organizational measures to ensure the security of the personal data being processed, with the aim of preventing loss, destruction, unauthorized access, alteration, or disclosure of such data.

  1. Rights

We inform you that every User of the Website may exercise, at any time and free of charge, the following rights:

  1. Right to be informed about the processing that Golf Peralada carries out of their personal data and to access such data (“right of access”);
  2. Right to obtain the rectification of inaccurate personal data (“right to rectification”);
  3. Right to request the deletion of their personal data (“right to erasure"), or, in certain cases, to restrict its processing (“right to restriction”);
  4. Right to request and, where applicable, obtain the portability of their data (“right to data portability”); and
  5. Right to object to certain processing activities involving their personal data (“right to object”).
  6. Right to withdraw your consent for the processing of your personal data for one, several, or all the purposes indicated above, insofar as such processing is based on your consent. Please note that, in such cases, this may affect the way we provide our services to you or may even result in their termination.
